Monthly invoices are sent via Square using a Card on File system. The card on file will be charged automatically if current and valid. Invoices will fail to charge if a card is inactive or expired; both DVMOLLC and Customer will be notified by Square. Client has 10 (ten) calendar days from the moment of a failed charge to update the payment method on file and allow charges to run; after 10 (ten) days DVMOLLC will suspend service until payment clears. Suspended service means that the website is not accessible on the Internet and no changes will be made to the website.
The monthly charges of $20/month include website hosting, including related server side (not content/what is displayed publicly to website visitors) maintenance necessary to keep reasonable uptime. Customer understands that downtime may occur due to required server reboots or circumstances outside the control of DVMOLLC, such as with upstream bandwidth providers. However, DVMOLLC is also expected to keep service disruptions to a minimum, including changing contracts with upstream bandwidth providers as needed, in order to maintain service. DVMOLLC will refund customers (via Square) for any outage exceeding 4 business hours, at the rate of 1/30 of the monthly hosting charge of $20, which is $0.67 (sixty-seven cents) per day.
The downtime guarantee detailed in the previous paragraph is considered void if Customer has administrative access to the website control panel, SiteJet Builder, or WordPress Admin, and downtime is caused by Customer's action in editing website settings or content. In this case, support may be purchased from the Chiropractic Website Support Team and DVMOLLC at the rate of $150 per incident. A refund for downtime is not owed to Customer until after two business days have elapsed from confirmation of the request for paid support, and the website not being restored to its prior condition and appearance before the action which caused the website to become inaccessible.
Customers who elect to have access to the website control panel, SiteJet Builder, or WordPress Admin will be subject to reasonable disk usage, bandwidth and content restrictions, including but not limited to: Customer may not host videos on the Website (videos may be hosted at YouTube or Vimeo and embedded into the website). Customer may be limited in disk space and bandwidth so as to ensure equal resource availability to other Customers. Customer may only publish content related to Chiropractic and related health and wellness. Off-topic, illegal or illicit content may be removed subject to the discretion of the Chiropractic Website Support Team and DVMOLLC.
All signups may be screened for legitimacy. This service is only available to Chiropractic Physicians and Chiropractic Practitioners for the purpose of a public website for Customer's Chiropractic practice. This service may not be used for any other general purpose web hosting or file storage. The Chiropractic Website Support Team and DVMOLLC reserve the right to decline or refuse service to anyone.
